Sehr geehrte Damen und Herren, Rules about the levying of fees and charges for services by the library of the Biberach University of Applied Sciences (Rules on Library Charges) dated 21st November 2006
On the basis of section 2 and section 19 of the Landeshochschulgebührengesetz (LHGebG - State Law on Tuition Fees in Higher Education) of 1st January 2005 ( Law gazette p. 56), amended by article 1 of the Law on the Amendment of the State Law on Tuition Fees in Higher Education and other laws of 19th December 2005, in conjunction with section 19, paragraph 1, point 10 of the Landeshochschulgesetz (State Law on Higher Education), the Senate accepted the following rules on charges at its meeting on 15th November 2006. The President of Biberach University of Applied Sciences agreed to these rules on 21st November 2006. § 1 General (1) Fees and charges are levied for the services of the library of the Biberach University of Applied Sciences in accordance with these rules. (2) Charges incurred in connection with the use of public services as per paragraph 1, but which are not included in the fees, are charged separately. (3) If these rules do not contain any regulations, then the State Law on Tuition Fees in Higher Education (LHGebG) together with the State Law on Higher Education (LGebG) are authoritative, in the respectively latest versions.
§ 2 Due date The due date of the fees and charges are based on section 18 of the State Law on Higher Education (LGebG).
§ 3 Reminder and late fees (1) If borrowed printed materials or other information carriers (library materials) are not handed back on time and a reminder about the return has been sent in writing or electronically, 1.50 Euros is charged for each borrowed item as well as an additional 5 Euro per item for the second reminder, and an additional 10 Euros for each further reminder per borrowed item. A borrowed item is any item lent out as one.

(2) If library materials are only on short-term loan, or over a period when the library is not open, a fee of 3 Euros is charged per borrowed item for each additional day when the library is open.
§ 4 Inter-library loan (1) For the transfer of library materials to another library in Germany (interlibrary loan) in accordance with the Leihverkehrsordnung (Inter-library loan regulations), for each order placed, regardless of its success, a fee of - 1.50 Euro for students of the University - 4.00 Euro for other users is charged. (2) If, according to the inter-library loan regulations, only copies are handed out, up to twenty copies can be transferred free-of-charge, and 0.10 Euro is charged for each additional copy. (3) Costs which are charged by the loaning library to the receiving library are to be borne by the person who made the order. In case of international loans of library materials, all expenses are to be refunded. (4) A processing fee of 2.50 Euros is charged for the reissuing of a damaged or lost media data carrier. § 5 Compensation for expenses (1) Expenses related to insurance, postal charges, requests at registration offices and similar have to be compensated. (2) The charges applicable due to the respectively valid contracts about the payment of copyright claims for the direct delivery of copies by public libraries (Entire "Direct delivery of copies" contract) are to be charged as compensation. The remuneration for the direct delivery of copies is carried out directly by the libraries to the collecting society "Wort".
§ 6 Lockers (1) Lockers can be used to deposit items, where available, by day during the opening hours of the library. (2) In case of damage due to improper use, failing to hand-back the key or losing the key, a processing fee of 20 Euro is charged for repair work or the exchange of the lock. Compensation claims remain unaffected by this.
§ 7 Replacement purchase (1) If a library item has to be repurchased, because the user has lost, damaged or not handed back the item after the third reminder, then the user has to compensate the library the costs for the replacement purchase or repairs as a special expense. Furthermore a processing fee of 16 Euros per unit can be charged.

The assertion of compensation claims remains unaffected. (2) Paragraph 1 applies correspondingly if library materials are no longer able to be replaced. (3) The charge demand and the value replacement made are not affected if the library item is handed back later.
§ 8 User ID (1) For students and employees of Biberach University of Applied Sciences the multi-functional chip card is also valid as a user ID for the library. (2) External users are issued with a library ID card upon presentation of their personal ID card. The issuing fee is 10 Euros. (3) The fee stated in paragraph 2 is not charged to students of other universities upon presentation of a valid form of student ID. § 9 Commencement (1) The rules about the levying of fees come into effect on 01.01.2007. With the commencement of these rules about the levying of fees at the library of the University of Applied Sciences, the rules of the Ministry for Science about the charging of library fees (Bibliotheksgebührenverordnung - Library Fees Ordinance) of 30.01.02 loses validity. (2) The rules about the levying of fees apply to fees and expenses, which are charged after the commencement of these rules. Any existing legal relationships concerning fees are processed according to the previously valid legal provisions.
