Rechnungsschluss für das Haushaltsjahr 2005 Sehr geehrte Damen und Herren, Rules Administrative and usage regulations of the library of the Biberach University of Applied Sciences dated 24.06.2009 On the basis of section 19, paragraph 10 of the Landeshochschulgesetz (LHG) (State Law on Higher Education) of 1st January 2005, last amended by article 2 of the Law of 3rd December 2008, the Senate of the University agreed the following administrative and usage regulations: I. Administrative regulations of the library § 1 The library (1) The library is a location-spanning operational unit and a central facility of the University as per section 28 of the LHG. (2) These administrative regulations apply to all services of the library and to all sites of Biberach University of Applied Sciences. § 2 Objectives (1) The library's objective is to supply the University with literature and media, and to operate the data processing systems in cooperation with RZ. (2) The library materials (books, loose-leaf services, periodicals, video media, videos and electronic media as well as other forms of information) are used for research, teaching and studying purposes at the Biberach University of Applied Sciences. (3) The library offers its materials in open access. -1- § 3 Management (1) The Senate shall appoint a Professor as the Scientific Manager normally every 4 years. This manager can be dismissed at any time for an important reason. (2) The manager is responsible for all approval questions, personnel matters and the commercial use of the allocated devices and rooms. He/she has, in particular, the following responsibilities: Representing the library to users and bodies of the University, Regular, at least annual, report to the President and the Senate about the management, Supervision of employees, Cooperation in the hiring of personnel and Running of the internal organisation § 4 Library committee (1) The library committee is a consulting committee of the Senate. It is responsible for the essential responsibilities associated with the services, irrespective of the responsibility of other bodies of the University. It promotes cooperation between the library and RZ and the exchange of information between the library and members of the University responsible for research and teaching. (2) The library committee is made up of: 1. The chancellery member responsible for courses 2. The President or his/her representative 3. The scientific manager of the library 4. The scientific manager of the research centre 5. The management team of the library 6. Two professors who have been elected by the Senate of the University of Applied Sciences for a term of 4 years. 7. Two students of the University who have been elected by the Senate for a term of one year § 5 Data protection The provisions of the Data Protection act have to be observed. II. Regulations on usage -2- § 1 Subject matter and type of usage (1) The University library promotes teaching, studying and research at the University of Applied Sciences. (2) This library is also available, irrespective of this role, to users with scientific and professional interests, who are not members of the University. (3) It fulfils its objectives by supplying, in accordance with the existing regulations, media at the premises of the library for use (non-lending collections) media for taking out of the library (open access library), and also provides information based on its catalogues and media § 2 Authorised users (1) All members of the University of Applied Sciences are authorised to use the library. (2) Other individuals, who guarantee that they will observe the regulations on usage and have a purpose as stated in section 1, can be authorised, provided they do not affect the interests of the users as per paragraph 1. (3) The authorisation can be restricted and given a time limit. § 3 Authorisation to use the library (1) The authorisation to use the library is carried out by admission into the library file. Anyone who is authorised receives a library card. (2) The authorisation of people who are not members of the University is carried out upon submission of their personal ID card and stating their address. (3) With the authorisation the user accepts the regulations of usage and declares his/her agreement about the storing of personal data. (4) If a member quits the University, then he/she has to prove that he/she has no more obligations to the library. All members of the University require a corresponding entry when leaving the University (discharge from liability note). (5) The library card is non-transferable. The user is liable for all media, which he/she has taken out on his/her card. § 4 Opening times (1) The normal opening times are agreed by the President and informed by means of a notice. -3- § 5 Behaviour in the library (1) Each user is obliged to adhere to the provisions of the regulations on usage and the instructions of the responsible library personnel. (2) Before entering the library, coats are to be left in the cloakroom, and bags and similar items are to be stored in the intended lockers. The only exception is for access to the book issuing desk in the open access library. (3) Eating and drinking is not permitted in the library rooms. (4) If users remove media from the intended locations in the library (normally from shelves), then they have to put them back after use. (5) Users are obliged to only use the internet workplaces in the library for research relating to studies, teaching and research. The internet workplaces are only available to members of the University of Applied Sciences. The library management shall decide about exceptions. (6) Users are obliged to behave in the library in a manner which corresponds to the character of the library as a scientific place of work. § 6 Handling of materials (Liability for compensation) (1) Users have to handle the materials of the library carefully. Entries of any kind and underlining are not permitted and shall be treated as damage. (2) The user is obliged to check the condition of media before borrowing, and to notify the library of any damage immediately. (3) The user is liable for damage and losses, which are incurred during use. He/she is obliged to provide an equal-value replacement within a suitable period of time. If the replacement is not provided, then the library shall determine a compensation fee for the repurchase or have a copy created and bound at the costs of the user. § 7 Making work copies (1) In the rooms of the library it is possible to make photocopies of articles from the non-lending collection, under observance of copyrights and other property rights. The costs for these copies are to be borne by the user. (2) The devices provided for copying are to be treated properly. § 8 Costs, information, ID obligation (1) The use of the library of the University of Applied Sciences is free-of-charge for members of the University, provided the regulations on usage do not set out anything contrary. (2) The personnel of the library are available for information. -4- (3) In order to protect the property of Biberach University of Applied Sciences, the personnel of the library have the right to ask users to show the contents of briefcases, handbags and similar items. § 9 Borrowing on-site (1) In general, materials are not allowed to be removed from the rooms of the library until they have been recorded at the issue desk. (2) The borrower is in particular liable for the proper condition of the borrowed item. (3) It is not permitted to take out items in the name of another person and to lend the item on. (4) Users have to inform the library immediately about changes to their personal address. (5) In all cases the user has to ensure that the borrowed item can be handed back at any time. (6) The user has to ensure that he/she receives reminders from the library. § 10 Borrowing (1) The user has to select the media on offer from the open access area (where necessary using the catalogue). (2) The borrowing begins with the removal of the media from the library shelf. From this point the borrower is responsible for the media according to the conditions of these regulations. (3) When making a request, borrowed media can be reserved for borrowing. (4) Reserved media does not have to be held for more than 14 days after the notification or expiry of the previous borrowing period or return by the previous borrower. (5) The library personnel are authorised to limit the number of media borrowed by an individual user at the same time. § 11 Borrowing period (1) In general the borrowing period is four weeks. (2) The manager of the library is entitled to shorten the borrowing periods in special cases. (3) The borrowing period can be extended up to five times. § 12 Borrowing limitations -5- (1) The following cannot be borrowed: - Non-lending collections, - Newspapers and periodicals, - Valuable and hard to replace books and other particularly sensitive library materials (e.g. portfolios, loose-leaf services, DIN standards etc.). (2) Media for which the borrowing term has been extended has to be returned immediately upon request. (3) In case of an audit the library is entitled to order the return of all borrowed items. § 13 Special conditions for Professors, Lecturers and Attendants of Biberach University of Applied Sciences (1) Professors and other full-time teachers at Biberach University of Applied Sciences are allowed to borrow media for teaching, scientific work and research activities, which count as "work" or "course reserves". This media has to be made temporarily available to other library users upon request. (2) In addition to these personal borrowings, long-term borrowings for a University facility are also possible. This media is classed as non-lending material and has to be available during normal working hours. § 14 Returns (1) Media is to be returned without request at the latest upon the expiry of the borrowing period. The return obligation also exists if the library requires and requests the borrowed item for internal reasons. (2) If media is returned in exceptional cases by post, the items are sent at the risk and cost of the sender. (3) If the user does not meet the return obligation, he/she can be sent a reminder by the library, stating the expired borrower period, where necessary several times, for a charge. (4) After three unsuccessful reminders the library is permitted to take other suitable measures (sending a return demand with a deadline by recorded delivery, initiating administrative enforcement proceedings, replacement purchase etc.). § 15 Costs and fees as well as reminder and late charges, which have to be refunded (1) Reminder and late charges are levied in accordance with the respectively valid library fee regulations, provided nothing contrary is set out in these regulations on usage. (2) If the amount owed exceeds 15 Euro, no further borrowings can be made until the due fee is paid. -6- § 16 Exclusion from using the library (1) If a user seriously or repeatedly violates the provisions of these regulations on usage, then the manager can exclude him/her temporarily or long-term from using the library. (2) The obligations of the user based on this usage relationship are not affected by this exclusion. An appeal can be made against the exclusion to the President of the University within four weeks. § 17 Liability of the library (1) The library is not liable for the loss of or damage to objects, which are brought into the library by users and/or stored there, unless they have been explicitly taken into custody. The storage of items in the lockers does not count as being taken into custody as per paragraph 1, line 1. In particular no liability is assumed for money, valuables, coats and bags. (2) The library is also not liable for damages which are caused by incorrect, incomplete, omitted or delayed services. § 18 Commencement These administrative and usage regulations come into effect on the day they are publicly announced.
